Isn't there some clause that prevents criminals from profiting from their crimes by writing books or scripts? I'm sure that now-deceased jailbird columnist at the 'Guardian' always used to moan about it. So how come this guy can be given taxpayer funds so cavierlierly? 

... the killer avoided prison after being convicted of manslaughter thanks to a diminished responsibility claim owing to his poor mental health. He was instead detained under sections 37 and 41 of the Mental Health Act 1983 and sent to a secure psychiatric unit where he will likely be eligible to receive universal credit payments. It means Tape is not classed as a prisoner and will not be transferred to a jail if he is released from hospital. As such, he is entitled to claim for up to £400 a month of benefits, unlike if he was detained under section 45A which excludes a person from receiving the taxpayer-funded money.

*sigh* Can he at least be billed for his board and lodging like they do with miscarriage of justice cases?

Low Hanging Fruit Again...

A woman says she was "shocked" when she was fined £150 for tipping the remnants of her coffee down a road gully in west London. Burcu Yesilyurt, who lives in Kew, said she thought she was acting "responsibly" when she poured out a small amount of coffee from her reusable cup down the drain rather than risk spilling it on the bus she was about to catch to work. But to her surprise, she was then stopped by three enforcement officers at the bus stop near Richmond station and fined under Section 33 of the Environmental Protection Act 1990, external. Richmond-upon-Thames Council said its officers "acted professionally and objectively" and that the fine was issued in line with its policies.

Of course they said that! They were hardly going to say ‘Ooops, we got it wrong!’ were they? 

Ms Yesilyurt said she had asked the enforcements officers if there were any signs or information warning people of the law but received no response.

Hardly surprising! 

Section 33 of the Environmental Protection Act 1990 makes it an offence to deposit or dispose of waste in a way likely to pollute land or water, including pouring liquids into street drains.

And is coffee considered a pollutant, or would any reasonable person feel that this act referred more to other liquids? Coffee is poured down the drain every day, albeit it’s probably phased through a deliveryman’s or taxi driver’s kidneys first…

The Richmond Council spokesperson said: "Nobody likes receiving a fine, and we always aim to apply our policies fairly and with understanding. "We are committed to protecting Richmond's waterways and keeping our borough's streets clean and safe 

"Enforcement action is only taken when necessary, and residents who feel a fine has been issued incorrectly can request a review."

But now you've backed down and cancelled the fine, so clearly, either you were wrong to issue it, or it's the weight of public ridicule and oprobium thats forced you to back down.

The council spokesperson said: "Fixed Penalty Notices clearly outline that there is an appeal process available to anyone who wishes to challenge them 

"It is likely that, had this case progressed through that route, the notice would have been rescinded because it is a minor contravention which the recipient agreed not to repeat."

Ah. Wrong then. Figures. 

Midazolam Matt

I Guess They Do All Look Alike, And Who Wants To Assume Gender In The Modern NHS?

A male migrant borrowed a female friend's identity to tend to seriously ill patients in the A&E unit at the NHS hospital where killer nurse Lucy Letby worked, a court heard. Lucius Njoku, 33, fraudulently used the name of agency nurse Joyce George to work as a healthcare assistant at the Countess of Chester Hospital, Chester.

And no-one questioned it. What's the point of photocards, then?  

Njoku was not spotted by colleagues despite wearing the woman's NHS name badge - complete with clear photograph, Chester magistrates' court heard. Over two months between February and April, he washed and dressed patients, and carried out observations.

Perhaps the fact that he apparently did some work and didn't stand around gossiping or flicking through a magazine should have given the game away? 

Thanks to a suspicious patient, he was finally caught:

He was only found out when a suspicious patient confronted Njoku and the fraudster blustered: 'My name is Joyce - but I am a man'. Inquiries revealed George, 32, also a Nigerian national living in nearby Ellesmere Port, obtained a job at the hospital via an outside agency after a successful interview.But she allowed Njoku to do her shifts under her name. It is not clear where he obtained his NHS uniform.

Yes, that's the critical take from this... 

Police raided George's home and found Njoku at the address. Mobile phones taken from both suspects showed exchange of text messages relating to shifts at the Countess. Both declined to comment in police interviews.

It is not known whether he will be deported as he is a 'dependent' on his wife's work visa.

Oh, I think it is known, given the utter uselessness of our justice system... 

George fled the UK after she was charged with fraud and is thought to have returned to Nigeria. An arrest warrant was issued.

They didn't seize her passport?  

Sentencing on Thursday, District Judge Jack McGarva told Njoku: 'You deceived your way into a job which requires safe guarding checks.' The judge said: 'That undermines the system. Although you were qualified and you did the work without complaint, that is not the point.'

They didn't 'undermine the system' Judge, they simply blew right through it!

Mine Remains Strangely Undented...

The family of a man shot dead by a police officer during a foiled prison break have accused Scotland Yard of evading accountability after a case against the marksman was thrown out.Baker’s family said there was no justification for the killing and questioned how W80’s action had escaped scrutiny. The police watchdog said the case has dented public confidence in police accountability.

There was every justification for the shooting since their family member was a criminal engaged in criminal pursuits. It’s insane that once again a cop who did his job is persecuted for it. 

The officer, known only as W80, shot Jermaine Baker as police stopped a plot to snatch two prisoners from a van near Wood Green crown court in 2015.Baker, a father of two from Tottenham, north London, was shot at close range by counter-terrorism specialist firearms officer W80, who thought Baker was reaching for a gun. Baker, who was sitting in the front passenger seat of a stolen Audi A6, was unarmed. An imitation firearm was later found in the back of the Audi, the misconduct hearing previously heard.

The fact it wasn’t a real gun means nothing. 

Prosecutors said in 2017 that there was insufficient evidence to bring criminal charges over the shooting, but the Independent Office for Police Conduct (IOPC) directed that the officer should face misconduct proceedings, prompting a lengthy legal dispute between the watchdog and the Metropolitan police.

The IOPC is not fit for purpose and needs to be shut down.
